AUTOMATED DECISION MAKING - RISKS, CHALLENGES AND OPPORTUNITIES

The use of automated decision making (ADM) by agencies presents both opportunities and risks. This presentation will explore what ADM is (and why not all AI qualifies as ADM), and then focus on the risks and challenges (as well as opportunities!) that government lawyers must be alert to as automated decision making is increasingly relied upon.

From a risk perspective, key issues such as algorithmic bias, inaccuracy, privacy concerns, and the lack of flexibility in ADM will be examined.

From a challenge perspective, the presentation will address the difficulties in applying traditional administrative law concepts to ADM, including determining the relevant decision maker, ensuring discretion is properly exercised, and making sure procedural fairness is afforded

Additionally, the presentation will briefly discuss the importance of involving lawyers when implementing ADM within an agency, the Attorney General’s consultation on ADM, recent changes to the Privacy Act related to ADM, and the government’s proposal to regulate high-risk AI.

 

INTO THE BREACH: NAVIGATING CYBER BREACHES AND CYBER PROTECTIONS IN CONTRACTING

This session explores the critical role of government lawyers in defending and protecting their department in the event of a cyber security breach.  Learn the essential steps to take to prepare for a breach, what to do when a breach occurs and what the legal teams will need to do as the investigation and long tail consequences of a breach unfold.  The session will also cover strategies for protecting government interests while negotiating procurement contracts, ensuring cyber security considerations are built into agreements to minimise future risks and liabilities, and compliance with PSPF and other policies and standards.

REBEKHA PATTISON

Rebekha is an experienced dispute resolution Partner focusing on administrative and public law, statutory interpretation, regulatory matters and inquiries / commissions. She has extensive experience representing the Commonwealth government in litigious administrative law matters including defending applications for review in the AAT and running applications for judicial review in the Federal and High Courts.

Rebekha regularly delivers training to administrative decision makers in making robust and defensible decisions, and assisting decision makers with contentious decisions, including advising about consultation processes (procedural fairness) and drafting statements of reasons.

 

KENDRA FOURACRE

Kendra is a senior member of KWM’s data and technology team. Her practice crosses over artificial intelligence, privacy law/data protection, technology contracting and regulatory compliance (including for telecommunications and the energy industries).

Kendra is currently an IAPP Certified Information Privacy Manager (CIPM), an IAPP Certification Privacy Professional (Europe) (CIPP(E)) and has previously taught International Cybercrime Law courses at the University of Canberra and acted as a guest lecturer at the University of Melbourne on regulating artificial intelligence.

Annie is a security and technology lawyer with 20+ years of experience advising government and private sector clients in security and technology law, risk, strategy and policy. She advises clients on procurement security considerations, security regulation, and cybersecurity risk mitigation. Annie’s deep technical understanding of technology and cybersecurity issues was gained during her 12 years as legal counsel for one of the world’s largest technology companies, Accenture, including 6 years as global legal counsel for its global cybersecurity business. Annie has been seconded to Commonwealth legal teams advising on risk, strategy, mitigations and controls for managing security risk across the organisation including compliance with applicable laws, the PSPF, ISM and agency policies. Annie has been awarded the Lawyers Weekly Australian Law Awards Sole Practitioner of the Year (2024), General Counsel of the Year (2021) award, and Lawyers Weekly, Corporate Counsel Awards, Technology, Media and Telecommunications Lawyer of the Year award (2021) for her work in security and technology law.

 

AMANDA WESCOMBE

Amanda is a security and technology lawyer and a trusted advisor to government and private sector clients.  She supports clients in identifying and mitigating commercial, legal, security and governance risks across all industries, and Commonwealth clients to comply with PSPF, ISM, and ANAO requirements.  She has held senior roles in private practice, at global technology companies, on secondment in Commonwealth government legal teams, and was the commercial and procurement manager for an international defence prime implementing its Major Service Provider program for Defence.

Event registration terms and conditions

ACT Law Society invoices have payment terms of 14 days. Fees are payable upon registration. A 1.2% surcharge may be incurred on payments processed via credit/debit card. The Society reserves the right to cancel or alter events at its discretion, and in such circumstances, attendees will be notified via email. 

Definitions — 'Registration' means any booking given to the Society in writing, on our website, or by phone. 'Member' means any member of the ACT Law Society, including associate members and honorary members. 'New Lawyer' means any member who has held a practising certificate for five years or less. 'CLC' means any member working for a recognised community legal centre, or holding a volunteer practising certificate. 'Student' means any member holding a student membership.

All cancellations must be made in writing, and all cancellations will incur a fee, however, no charge will be incurred for substituting another person. Outside of the cancellation periods given below, a $10 administration fee will be incurred for any cancellation made. If a registered attendee fails to attend without notifying the Society in writing, no credit or refund will be offered and 100% of the total cost will be retained by the Society. 

CPD Events — In the case of CPD events held at an venue other than the Law Society, no refund can be made after the RSVP date of the event. In the case of CPD events held at the Law Society, for cancellations made up to two working days prior to the event, 50% of the total cost will be retained by the Society as a cancellation fee and the balance may be used as a credit towards other CPD events or be refunded. If you choose to keep a credit it will remain valid for 12 months from the event date, after which time it will expire. For cancellations within two working days of the event, no refunds or credits will be applicable. 

Webinars — In the case of live or on-demand webinars, as connection details are sent when registration is completed, no refund or cancellation is available. 

Social events — In the case of social events, no refund can be made after the RSVP date of the event.

Attendees of events consent to filming, photography and sound recording as members of the audience. By registering and attending this event you agree to being filmed or photographed which may be used for marketing or promotional purposes
