The ACT Law Society is the peak body for legal practitioners in the ACT. The Society represents, advances, and defends the interests of an independent legal profession in the ACT. We also protect the public interest in the ACT system of justice through efficient regulation of the profession.

We are a small, dedicated, and supportive team of staff working with more than 3000 members across all parts of the legal profession in the ACT. The Society advocates for the profession with key stakeholders and provides a range of services for members, including providing information resources and guidance, and delivering a range of continuing professional development and networking activities throughout the year.

About us

The Society also has regulatory responsibilities, including licensing legal practitioners in the ACT and investigating and resolving complaints about the conduct of practitioners.

 

The Opportunity

Reporting directly to the CEO, this newly created role will oversee all aspects of regulation of the local legal profession, from licensing through to disciplinary proceedings. As part of the Society’s leadership team, the Regulatory Services Manager will be responsible for building and leading a high performing team responsible for licensing, complaint administration, investigations, mediation and litigation.

The role will ensure the Society’s ongoing compliance with our legislative responsibilities, supporting the CEO, Council, Executive Committee and Professional Standards Committee as appropriate, and ensuring that regulatory services are delivered effectively for the protection of the public and to support high standards of legal practice.

To be successful in the role, you will have strong people management experience with the capability to recruit and manage a small and dedicated team to deliver the Society’s regulatory functions in a timely, effective and transparent manner. You will be responsible for reporting on the work of the regulatory services team and development of guidance to support practitioner compliance. Leveraging data collated by the team, you will collaborate and contribute to educational opportunities to promote high professional standards. You will bring a fresh perspective to our regulatory functions and have a demonstrated commitment to best practice and continuous improvement, as well as the utmost personal and professional integrity to ensure trust in the Society’s regulatory functions.

An important responsibility will be recruiting an inhouse legal investigations team to support the Society’s complaint investigation functions, which to date have been outsourced to external legal advisors.

 

Responsibilities

  • Oversee the delivery of all of the Society's regulatory functions relating to admission, licensing, trust accounts, complaints and investigation, external interventions, and disciplinary functions
  • Under delegation perform relevant regulatory functions under the LPA
  • Manage the preparation of briefing papers for Council and PSC on regulatory matters
  • Develop policies and procedures to facilitate the transparent and accountable delivery of the Society's regulatory functions
  • Provision of regulatory information and guidance to members of the profession, members of the public and interstate counterparts
  • Manage appointments and reporting in relation to external interventions
  • Ensure compliance of the Society with all regulatory requirements
  • Effectively manage the performance of staff within the Regulatory Services team, including recruitment, development and performance review and the budgeted income and expenditure for the team
  • Actively contribute and provide input to the CEO and the Society's Leadership Team

 

Qualifications

Essential

  • Admission to the Roll of a Supreme Court and holder of (or eligibility to hold) a current ACT unrestricted practising certificate
  • No less than 10 years in the practice of law and experience in a broad range of areas of legal practice
  • Demonstrated highly developed skills in written and oral communications
  • An ability to quickly acquire a thorough understanding and application of the statutory framework for the regulation of legal practitioners in the ACT including associated local and Commonwealth legislation
  • Excellent legal research and analytical skills
  • Demonstrated strong organisational ability and attention to detail
  • Ability to work independently and with minimal supervision, and production of high-quality reports and advice at short notice
  • This role is subject to a police check and satisfactory professional conduct

Desirable:

  • Experience with the regulation of professional conduct and discipline
  • Experience in court advocacy and/or mediation
  • Experience in a regulatory or complaint handling environment will be an advantage as well a good understanding of administrative law principles
